Hancock County Fees & Waivers

Filing fees and court costs are a standard part of the court process, but we understand they can create a barrier for some individuals. Discover information about current filing fees for civil cases, as well as options for requesting a fee waiver or reduction if you are unable to afford court costs. If you have questions about whether a fee applies to your specific filing, please contact the Hancock County Circuit Clerk's Office.

Fee Schedule

Fees for new filings are due at the time of filing. Copy fees must be paid prior to copies being processed and sent. Copy requests submitted by mail must include a self-addressed, stamped envelope for return. The Circuit Clerk’s Office does not accept mail with postage due; such items will be returned to the sender marked “refused.”

Waiver of Court Fees in Civil Cases

Most court filings require a fee, and there may also be a fee for serving documents on other parties in the case. If you are unable to afford these fees, you may request that the Court waive or reduce them. Illinois Legal Aid Online (Fee waiver (Easy Form) | Illinois Legal Aid Online) offers a guided interview to help you complete the necessary forms to request a fee waiver or reduction.

Waiver of Fees/Assessments in Criminal Case

When a person is convicted of an offense in Illinois, the Court is required to enter a judgment for the costs of prosecution. Assessments are charges imposed on a defendant in a criminal case upon a finding of guilt. These assessments do not include fines, restitution, or fees related to violations of the Illinois Vehicle Code. A waiver of criminal assessments may not apply to all costs and fees associated with a case.

Illinois Legal Aid Online offers a guided interview to assist individuals in preparing the necessary documents to request a waiver or reduction of criminal court assessments. These forms may be used for felony and misdemeanor cases, but do not apply to traffic cases or other petty offenses.

Effective January 1, 2024, individuals who are convicted and incarcerated may not be required to pay outstanding fines, costs, or fees related to their criminal case during the first 180 days following their release from incarceration
